Admissibility of second-stage appeal against non-admission of revision in civil dispute
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) rejected the defendant's complaint against the non-admission of a Revision appeal, thereby upholding the lower court's decision and ordering the defendant to bear the costs of the appellate proceedings; the summary dispute involved a civil matter valued at up to €50,000, where the defendant challenged the 9th Civil Senate of the Munich Higher Regional Court's refusal to permit a further appeal; the decision was issued without a written legal reasoning under § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, as such a statement was deemed incapable of contributing to the clarification of the prerequisites for admitting a Revision.
