Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice (BGH) dismissed the plaintiff’s complaint against the non-admission of revision, thereby upholding the Oberlandesgericht Bamberg judgment of January 25, 2024, and leaving the original appellate decision in force; the plaintiff was ordered to bear the costs of the complaint proceedings, with the subject matter in dispute valued at €290,224.79. The dispute concerned a civil matter where the plaintiff sought to challenge the lower court’s refusal to allow appeal to the BGH, arguing that the revision admissibility requirements were met. The BGH rejected the complaint under § 544(6) sentence 2, second half-sentence ZPO, declining to provide a substantive reasoning because it would not contribute to clarifying the prerequisites for admitting a revision, and applied § 97(1) ZPO for cost allocation.
