BGH denies leave to appeal in civil dispute involving €265,000 in controversy
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the lower court's refusal to grant leave for appeal, thereby affirming the judgment of the Munich Higher Regional Court and leaving the defendant's position intact; the court declined to provide a reasoned decision, deeming it unnecessary for clarifying the prerequisites for appeal admission. The dispute involved a civil matter with a monetary value in dispute of €265,000, where the plaintiff challenged the procedural decision by the appellate court to deny the admission of a further revision. The decision was based on § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, which permits the BGH to omit grounds when such a statement would not contribute to the clarification of the conditions under which a revision must be admitted.
