Legislator-Zusammenfassung

KI-generiert

The German Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the non-admission of revision, thereby allowing the Oberlandesgericht München's decision to stand and leaving the appellant to bear the costs of the legal proceedings. The dispute concerned a civil matter with a value in dispute of €73,132.50, where the plaintiff had challenged the lower court's refusal to admit an appeal to the federal level. The court applied § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, explicitly waiving the substantive reasoning for the dismissal as it was deemed unnecessary for clarifying the prerequisites for admitting revision, and invoked § 97 Abs. 1 ZPO for the cost allocation.
