Non-acceptance of revision complaint: waiver of reasoning under § 544(6) sentence 2 ZPO for non-contribution to case law
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) dismissed the defendant's non-acceptance complaint (Beschwerde) against the Kammergericht's refusal to allow the appeal in revision, leaving the lower court's judgment in force and ordering the defendant to bear the costs of the proceedings, including those caused by third-party interventions on the plaintiff's side. The dispute, valued at €178,089.46, involved a civil matter where the defendant challenged the appellate court's decision not to permit a third-instance review. The BGH declined to provide a written reasoning for the dismissal, citing that an explanation would not contribute to clarifying the prerequisites for allowing a revision under § 544(6) sentence 2, second half-sentence of the Code of Civil Procedure (ZPO).
