Legislator-Zusammenfassung

KI-generiert

The Federal Court of Civil Jurisdiction (BGH) dismissed the plaintiff's complaint against the lower court's refusal to allow an appeal in revision, upholding the Oberlandesgericht Koblenz's decision of September 25, 2023, and ordering the plaintiff to bear the costs of the complaint proceedings. The dispute arose from a civil litigation matter with a disputed value of €36,192.39, in which the plaintiff challenged the legal admissibility of the second instance decision. The BGH declined to provide a detailed written justification, applying § 544 Abs. 6 Satz 2 ZPO because such an explanation would not contribute to clarifying the prerequisites for granting leave to appeal, while the cost allocation was determined under § 97 Abs. 1 ZPO.
