Omission of reasoning for rejection of leave to appeal for revision
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) Seventh Civil Senate dismissed the plaintiff’s complaint for leave to appeal, thereby leaving the lower court’s judgment in force and ordering the plaintiff to bear the costs of the complaint proceedings, including those incurred through auxiliary interventions. The dispute concerned a civil case with a disputed value of €354,997.98, where the plaintiff challenged the Higher Regional Court of Schleswig-Holstein’s refusal to admit revision in its judgment of December 9, 2022. The BGH declined to provide a substantive justification for the dismissal, relying on the statutory provision that a statement of reasons is unnecessary if it would not contribute to clarifying the preconditions for admitting revision.
