Non-admission of revision: waiver of reasoned decision under § 544 Abs. 6 ZPO
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Procedure (BGH) dismissed the defendant's complaint against the non-admission of a revision appeal, thereby allowing the judgment of the 13th Civil Senate of the Higher Regional Court Frankfurt am Main to become final, with the defendants bearing the costs of the proceedings. The dispute concerned a civil claim with a subject matter value of €25,135.18, where the appellate court had declined to admit the constitutional-level revision due to a lack of sufficient legal significance. The court explicitly declined to provide a detailed reasoning under § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, as such an explanation would not contribute to clarifying the prerequisites for admitting a revision, and ordered the defendants to pay the procedural costs pursuant to § 97 Abs. 1 ZPO.
