Legislator-Zusammenfassung

KI-generiert

The defendant's appeal against the refusal to admit a revision appeal was dismissed, with the defendant ordered to bear the costs of the proceedings, thereby upholding the lower court's decision. The case involved a civil dispute with a subject matter value of €186,300, where the defendant challenged the appellate court's decision to deny leave for a third-instance review. The Federal Court of Justice (7th Civil Senate) rejected the complaint without a substantive written justification, relying on § 544(6) Sentence 2, second half-sentence of the Code of Civil Procedure (ZPO), which exempts the court from providing reasons if such an explanation would not contribute to clarifying the prerequisites for admitting a revision.
