Legislator-Zusammenfassung

The Federal Court of Justice (BGH) dismissed the plaintiff's complaint for leave to appeal (Nichtzulassungsbeschwerde) against the Higher Regional Court of Cologne's refusal to admit revision, thereby upholding the lower court's procedural ruling and rendering the decision final; the plaintiff was ordered to bear the costs of the complaint proceedings, including those incurred by the intervention of a third party on the defendant's side, with a subject matter value of €913,352.01. The dispute involved a civil matter where the plaintiff challenged the procedural denial of revision in a case of significant financial magnitude. The court explicitly declined to provide a written justification for the dismissal, citing § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, on the grounds that such an explanation would not contribute to clarifying the prerequisites under which revision should be admitted, thereby relying on the procedural standard that a detailed rationale is not required when it would not enhance legal certainty regarding the admission criteria.
