Denial of revision admission without reasoned justification under civil procedure rules
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff's complaint against the non-admission of revision, resulting in the plaintiff's defeat and an order to bear the costs of the complaint proceedings, including those incurred by the intervenor on the defendant's side. The dispute, with a subject matter value of €23,622.26, involved a motion to have the revisionary instance admitted after the Higher Regional Court of Bamberg rejected it in a civil matter. The decisive legal basis was § 544 para. 6 sentence 2 second half-sentence ZPO, under which the court dispensed with a written statement of reasons because such a justification would not contribute to clarifying the conditions for admitting a revision, alongside §§ 97 para. 1 and 101 para. 1 ZPO governing the cost allocation.
