Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice (BGH) rejected the defendant's complaint against the refusal to grant leave for revision, thereby upholding the judgment of the Higher Regional Court of Stuttgart and leaving that lower-court decision in force, with the defendants bearing the procedural costs and the defendant's amicus curiae bearing its own out-of-court costs. The dispute concerned a civil law matter, identified by a value in dispute of €45,000, which the defendant had challenged via an appeal for admission of revision after losing in the lower instance. The court's decision relied on § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO to waive a substantive justification, determining that such an explanation would not contribute to clarifying the prerequisites for admitting a revision, while applying §§ 97 Abs. 1 and 101 Abs. 1 ZPO for the allocation of costs.
