Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice dismissed the plaintiff's complaint against the non-admission of revision, leaving the prior judgment by the 21st Civil Senate of the Kammergericht in force; the plaintiff bore the costs of the complaint proceedings, and the court waived a detailed reasoned decision as it would not contribute to clarifying the prerequisites for admitting revision. The dispute concerned a civil matter with a value in dispute of €321,781.76, specifically challenging the lower court's refusal to grant the extraordinary appeal. The decisive legal basis for the outcome was § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, which permits the court to omit the reasoning for a dismissed complaint if such reasoning is not suited to elucidating the conditions under which a revision must be admitted.
