Revision admission threshold and cost allocation for non-admission complaints in civil proceedings
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) 7th Civil Senate rejected the plaintiff's complaint against the non-admission of an appeal in revision, leaving the Upper Regional Court’s decision of June 29, 2021, in force; the plaintiff did not prevail and was ordered to bear the costs of the complaint proceedings, including those arising from the defendant’s side-intervention, with a subject matter in dispute valued at €238,000. The court dispensed with a written legal reasoning, citing that such an explanation would not contribute to clarifying the prerequisites for admitting revision, thereby applying the procedural doctrine that detailed grounds are unnecessary when the appeal fails to demonstrate significant legal significance. The decision relied on § 544 Abs. 6 Satz 2, second half-sentence ZPO for the omission of reasons, and §§ 97 Abs. 1, 101 Abs. 1 ZPO for the cost allocation.
