Legislator-Zusammenfassung

The German Federal Court of Justice (BGH), 7th Civil Senate, dismissed the plaintiff's complaint against the non-admission of revision, leaving the lower court's decision in force and awarding costs to the opposing party. The dispute concerned a civil matter with a litigation value of €80,000, in which the plaintiff sought to challenge the appellate court’s refusal to allow further appeal. The court rejected the complaint without providing a written reasoned decision, relying on § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, which permits omitting the explanation when it would not contribute to clarifying the conditions for admitting revision, and applied § 97 Abs. 1 ZPO to allocate the costs of the complaint procedure to the plaintiff.
