Legislator-Zusammenfassung

The German Federal Court of Civil Procedure (BGH) dismissed the defendant's appeal against the non-admission of its revision, thereby upholding the lower court’s procedural decision and ordering the defendant to bear the costs of the appeal proceedings. The dispute, valued at €75,855.36, concerned a civil matter where the defendant sought to challenge the judgment of the Braunschweig Higher Regional Court, which had previously denied permission for a further appeal to the BGH. The court dismissed the appeal without substantive reasoning, applying the provision that a detailed explanation is omitted when such an explanation would not contribute to clarifying the prerequisites under which a revision must be admitted.
