Dismissal of complaint against non-admission of revision: refusal of reasoning under § 544 Abs. 6 ZPO and cost allocation
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Procedure (BGH) rejected the plaintiff’s complaint against the non-admission of an appeal to the Supreme Court (Revision), thereby leaving the earlier judgment final and ordering the plaintiff to bear the costs of the proceedings. The case arose from a civil dispute in the jurisdiction of the Dresden Higher Regional Court, where the plaintiff failed to demonstrate the legal significance necessary to justify admitting the appeal. Relying on Section 544(6) Sentence 2 of the Code of Civil Procedure, the BGH declined to provide a reasoned decision because such an explanation would not contribute to clarifying the prerequisites for admitting revision, and the court set the subject matter value at €28,500.84.
