The Federal Court of Justice dismissed the plaintiff’s appeal against the refusal to admit a revision appeal in a civil dispute, thereby upholding the decision of the Kammergericht and leaving that judgment in force. The case involved a civil litigation where the plaintiff sought to challenge the appellate court’s refusal to allow a third-instance appeal, a procedural stage governed by strict admissibility requirements. The court relied on § 544 Abs. 6 Satz 2, second half-sentence, of the Code of Civil Procedure (ZPO), which permits the omission of a detailed written reasoning for the dismissal if such reasoning would not contribute to clarifying the conditions for the admission of a revision appeal, and ordered the plaintiff to bear the costs of the complaint proceedings pursuant to § 97 Abs. 1 ZPO.
