The German Federal Court of Justice (BGH) dismissed the defendant's complaint against the non-admission of a revisionary appeal, leaving the Oberlandesgericht München's decision in force and ordering the defendant to bear the costs of the complaint proceedings. The dispute involved a civil matter with a subject matter value of €65,598.75, where the appellate court had previously refused to permit the revisionary appeal. The BGH declined to provide a detailed written reasoning, invoking § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, as such a justification was deemed not conducive to clarifying the prerequisites for admitting a revision, and the decision was grounded in § 97 Abs. 1 ZPO regarding cost allocation.
