Legislator-Zusammenfassung

The Federal Court of Justice (BGH) dismissed the plaintiff's appeal against the denial of leave to appeal for revision, thereby upholding the Kammergericht’s decision of 17 January 2023; consequently, the plaintiff bears the costs of the appeal proceedings, including those arising from the defendant's auxiliary intervention. The dispute concerned a civil matter with a value in dispute of approximately €525,589.10, where the appellant sought to establish the admissibility of a revision by demonstrating fundamental legal issues, but failed to meet the statutory requirements. The court explicitly waived providing a substantive reasoning, relying on § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, which permits omitting grounds when they would not contribute to clarifying the conditions under which revision should be granted, and applied §§ 97 Abs. 1 and 101 Abs. 1 ZPO to allocate the procedural costs to the unsuccessful appellant.
