Omission of reasons in complaint against non-admission of revision under § 544 Abs. 6 ZPO
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) 7th Civil Senate dismissed the plaintiff’s complaint against the refusal to admit a revision appeal, thereby upholding the lower court’s decision and leaving the plaintiff to bear the costs of the proceedings; the subject matter involved a civil dispute valued at €42,379.08, where the plaintiff challenged the procedural denial of access to the federal court level. The court decided without providing a detailed written reasoning pursuant to § 544 Abs. 6 Satz 2, second half-sentence of the Code of Civil Procedure (ZPO), as the omission was deemed not conducive to clarifying the statutory prerequisites for admitting a revision, thus resolving the procedural challenge under the specific non-disclosure rule for complaints against non-admission of revision.
