The Federal Court of Justice (BGH) rejected the plaintiff's complaint against the non-admission of their appeal, leaving the decision of the Munich Higher Regional Court in force and imposing the costs of the complaint proceedings on the plaintiff. The dispute, valued at approximately €161,000, involved a challenge to the lower court's refusal to allow a revision appeal in a civil matter. The court relied on § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, expressly waiving a written reasoned decision as it would not contribute to clarifying the conditions for admitting an appeal, and addressed cost allocation under §§ 97 Abs. 1 and 101 Abs. 1 ZPO.
