The German Federal Court of Justice (BGH) dismissed the defendant's non-admission complaint against the Oldenburg Higher Regional Court's refusal to permit appeal to the Supreme Court, leaving the appellate judgment in force; the defendant was ordered to bear the costs of the complaint proceedings. The dispute, involving a value of approximately €701,596, concerned a civil matter where the defendant challenged the lower court's decision not to allow a revisionary appeal, asserting that the case warranted such review. The court denied the request to provide a reasoned decision under § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, determining that a justification would not contribute to clarifying the conditions for admitting a revision, thereby upholding the procedural requirement that non-admission complaints must demonstrate significant legal issues of fundamental importance to justify further review.
