The Federal Court of Justice (BGH) dismissed the plaintiff's complaint regarding the non-admission of revision, thereby leaving the judgment of the Higher Regional Court of Rostock in force and ruling in favor of the defendant. The dispute concerned a civil matter where the plaintiff challenged the lower court's decision not to allow an appeal to the supreme court for legal review, with a matter in dispute valued at €234,440. The BGH ordered the plaintiff to bear the costs of the complaint proceedings, including those arising from the defendant's auxiliary intervention, while the plaintiff's own auxiliary counsel bore their own costs. The decision was issued without written grounds, as the court determined that such an explanation would not contribute to clarifying the conditions for admitting revision, pursuant to § 544 Abs. 6 Satz 2, 2nd Half-Sentence ZPO and § 97 Abs. 1, § 101 Abs. 1 ZPO.
