Omission of reasoned decision on revision admissibility complaint under § 544(6) ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the defendant’s complaint for lack of revision admissibility, leaving the judgment of the Brandenburg Higher Regional Court from November 8, 2023, in force, with the defendant bearing the costs of the complaint proceedings for a dispute value of €100,000. The case involved a civil dispute where the defendant challenged the appellate court’s refusal to allow an appeal to the Supreme Court. The court ordered no reasoned decision under § 544(6) sentence 2, second half-sentence of the Code of Civil Procedure (ZPO), as such a rationale would not contribute to clarifying the prerequisites for admitting revision.
