Refusal to admit revision and waiver of reasoning under § 544 Abs. 6 Satz 2 ZPO
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Procedure dismissed the defendant’s complaint against the Berlin Court of Appeal’s refusal to admit an appeal to the supreme court, thereby leaving the lower court’s decision in force and ordering the defendant to bear the costs of the complaint proceedings. The dispute involved a civil matter with a subject matter value of €572,169.26, where the defendant challenged the appellate court's determination that the appeal lacked the necessary significance for admission to the supreme court. Relying on § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, the court declined to provide a detailed reasoning, concluding that such an explanation would not contribute to clarifying the conditions under which an appeal may be admitted, and affirmed the costs allocation under § 97 Abs. 1 ZPO.
