Non-admission of revision in civil proceedings: waiver of reasoning under § 544(6) ZPO where it does not clarify admission conditions
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice rejected the defendant's complaint against the non-admission of leave to appeal, leaving the judgment of the Higher Regional Court in force, with the defendant bearing the costs of the proceedings. The dispute arose from a civil matter in the 7th Civil Senate context, specifically challenging the lower court's decision not to grant leave for a revision appeal in the underlying lawsuit. The decision was rendered without further reasoning under § 544 Abs. 6 Satz 2 Halbsatz 2 ZPO, as the court determined that providing an explanation would not contribute to clarifying the conditions under which a revision is to be admitted, resulting in the final dismissal of the defendant's procedural attempt to escalate the case.
