The German Federal Court of Justice (BGH) dismissed the defendant's complaint against the non-allowance of leave to appeal on points of law, thereby upholding the lower appellate court's decision and leaving the defendant to bear the costs of the complaint procedure as a joint and several debtor. The dispute involved a civil matter concerning a disputed value of 79,799.17 EUR, where the defendant sought to challenge the appellate court's refusal to permit revision. The court refused to provide a written justification for its dismissal pursuant to § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, reasoning that such an explanation would not contribute to clarifying the prerequisites for the admissibility of revision, thus relying on the procedural standards for non-admission of appeals.
