Objection to non-acceptance of revision in civil liability dispute: dismissal without reasoning under § 544 Abs. 6 Satz 2 ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the defendant's complaint for non-acceptance of revision, thereby upholding the final judgment of the Munich Higher Regional Court, which resulted in the plaintiff prevailing in a civil dispute with a subject matter value of €60,761.90. The case concerned a civil liability matter where the defendant challenged the appellate court's refusal to grant leave to appeal to the supreme court. Relying on Section 544 (6) sentence 2, second half-sentence, and Section 97 (1) of the Code of Civil Procedure, the BGH declined to provide a written reasoning for the dismissal, as it was not deemed suitable for clarifying the prerequisites for admitting revision, and ordered the defendant to bear the costs of the complaint proceedings.
