Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice (BGH) dismissed the defendant’s complaint against the non-admission of an appeal to the courts of last instance, thereby upholding the decision of the Higher Regional Court of Nuremberg and leaving the lower court’s judgment in force, with the defendant bearing the costs of the complaint proceedings and a value in dispute of €210,465.80. This procedural ruling addressed a civil dispute where the defendant challenged the admissibility of an appeal on the grounds of supposed legal significance, but the BGH declined to provide a substantive reasoning because doing so would not contribute to clarifying the conditions under which such an appeal should be admitted. The decisive legal basis for the decision was § 544(6) sentence 2, second half-sentence of the Code of Civil Procedure (ZPO), which permits the court to omit a reasoned decision on a complaint against non-admission of an appeal if such a reasoning is deemed unnecessary for clarifying the relevant legal prerequisites.
