Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the denial of leave to appeal, thereby upholding the final judgment of the Bamberg Higher Regional Court and leaving the defendant as the prevailing party. The dispute concerned a civil matter where the plaintiff sought to challenge the lower court's decision through a non-admission of revision proceeding, failing to demonstrate sufficient importance to justify appellate review. The court applied § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO to waive a detailed written justification for the dismissal, as it would not contribute to clarifying the prerequisites for admitting revision, and imposed the costs of the proceedings on the plaintiff pursuant to § 97 Abs. 1 ZPO, setting the amount in dispute at 22,899.50 euros.
