Legislator-Zusammenfassung

KI-generiert

The German Federal Court of Justice (BGH) dismissed the defendant's complaint against the non-acceptance of the revisionary appeal, thereby upholding the prior decision of the 16th Civil Senate of the Cologne Higher Regional Court; the defendant bears the costs of the proceedings, with a subject matter value of €41,724.63. This procedural decision concerns a civil dispute where the defendant sought to challenge the appellate court's refusal to permit a further appeal to the BGH, but the court declined to provide a written justification under § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, as such a statement would not contribute to clarifying the conditions for granting revisionary leave. The decisive legal basis involves the procedural standards for admitting revision under the German Code of Civil Procedure (ZPO) and the allocation of litigation costs under § 97 Abs. 1 ZPO.
