Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice (BGH) dismissed the defendant's complaint against the non-admission of revision, upholding the Munich Higher Regional Court's decision and leaving the lower court judgment in force; the defendant was ordered to bear the costs of the appellate proceedings. The case involved a civil dispute where the defendant challenged the appellate court's refusal to allow an appeal to the BGH on grounds of alleged legal error or significance. The BGH denied the request for a written justification under Section 544(6) sentence 2, second alternative, of the German Code of Civil Procedure (ZPO), determining that such a rationale would not contribute to clarifying the prerequisites for admitting a revision, with the issue in dispute valued at approximately €164,000.
