Rejection of non-admission complaint against revision without reasoned opinion under ZPO cost and cost-shifting rules
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Justice (BGH) rejected the plaintiff's complaint against the non-admission of leave to appeal, leaving the judgment of the Stuttgart Higher Regional Court in force and ordering the plaintiff to bear the procedural costs. The dispute concerned a civil claim subject to review under the German Code of Civil Procedure, where the lower court had declined to admit the case for revision. The appellate court dispensed with a reasoned opinion pursuant to § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, determining that such a rationale would not contribute to clarifying the conditions under which leave to appeal should be granted.
