Rejection of complaint against non-admission of revision without reasoning under § 544 Abs. 6 Satz 2 ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) Seventh Civil Senate rejected the plaintiff's complaint against the non-admission of revision, thereby upholding the Stuttgart Court of Appeal's partial judgment and award for liability; the plaintiff bore the costs of the complaint proceedings, excluding those caused by the opposing side's ancillary intervention. The dispute concerned a claim for damages where the lower court had rendered a decision that was not appealed to the supreme court, with a dispute value of €960,126.03. The court declined to provide a detailed reasoning pursuant to § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, holding that such a justification would not contribute to clarifying the conditions under which a revision appeal should be admitted.
