Legislator-Zusammenfassung

KI-generiert

The German Federal Court of Justice (BGH) rejected the defendant's complaint against the refusal to grant leave for revision, leaving the lower court's judgment in force; the defendant was ordered to bear the costs of the appellate proceedings, with a disputed value of €4,422.70. The case involved a civil dispute where the defendant sought to challenge an appeal court decision, but the BGH deemed a written justification unnecessary as it would not contribute to clarifying the preconditions for admitting a revision. The decision rests on § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, which permits omitting the reasoning in non-merit determinations when it does not aid in defining the standards for granting leave for revision, and § 97 Abs. 1 ZPO for cost allocation.
