Cost allocation and omission of reasoning for dismissal of complaint against non-admission of revision under §§ 544, 97 ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the auxiliary intervener's complaint against the denial of leave to appeal, thereby upholding the lower court's decision and leaving the original judgment in force, with the intervener bearing the litigation costs for a subject matter in dispute of €86,385.74. The case involved a civil dispute where the appellate court had refused to allow a revision appeal, and the BGH declined to provide a reasoned decision because one would not contribute to clarifying the prerequisites for admitting a revision under § 544(6) sentence 2, second alternative, of the Code of Civil Procedure (ZPO). The decision is based on procedural law governing leave to appeal, specifically the standard for when a reasoned opinion is unnecessary to maintain the status quo of the denied revision.
