Waiver of written justification for non-admission of revision where reasoning would not clarify admissibility prerequisites
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) dismissed the defendant's complaint against the non-admission of revision, thereby upholding the Lower Senate of the Oldenburg Court of Appeals' refusal to allow the case to proceed to the federal level, with the defendant bearing the costs of the complaint proceedings. The dispute concerned a civil matter with a disputed value of €40,222, where the appellate court had previously denied admission of the constitutional or supreme court review. The BGH invoked § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO to waive a detailed written justification, determining that such reasoning would not contribute to clarifying the prerequisites for admitting revision. Consequently, the appellate court's procedural ruling remains in force, and the lower-instance judgment stands final between the parties.
