Legislator-Zusammenfassung

KI-generiert

The German Federal Court of Justice (BGH) dismissed the defendant's complaint against the non-admission of revision, leaving the decision of the Munich Higher Regional Court (OLG) dated March 12, 2024, in force, with the defendant bearing the costs of the complaint proceedings; the case involved a civil dispute with a subject matter value of €100,000, where the higher court had previously refused to allow the appeal to the BGH. The BGH’s order relies on § 544(6) sentence 2, second half-sentence ZPO, which permits the court to omit a written justification if one would not contribute to clarifying the conditions for admitting revision, and § 97(1) ZPO regarding cost allocation.
