The Bundesgerichtshof dismissed the defendant’s complaint against the non-admission of the revision, thereby upholding the decision of the Düsseldorf Higher Regional Court and leaving the lower court’s ruling in force, with the defendant’s auxiliary intervener ordered to bear the procedural costs. The dispute concerned a claim for damages, evidenced by an object value of €675,400, where the defendant challenged the trial court’s refusal to allow an appeal to the supreme court. The court applied § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, waiving a written statement of reasons as it would not contribute to clarifying the prerequisites for admitting a revision, and applied §§ 97 Abs. 1, 101 Abs. 1 ZPO to allocate the costs of the auxiliary intervention to the intervening party.
