Objection to non-admission of revision: Justification omission under § 544(6) No. 2 ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Civil Procedure dismissed the defendant's complaint against the non-admission of revision by the Higher Regional Court, thereby upholding the lower court's denial of appellate review and leaving the prior judgment in force. The dispute concerned a civil matter with a subject matter value of €40,313.46, in which the defendant argued that the appeal to the Federal Court should have been admitted, but the court found no merit in these arguments. The decision was issued without a detailed written justification because the court determined that such a rationale would not contribute to clarifying the conditions for admitting revision, a procedure governed by § 544 Abs. 6 Satz 2 ZPO, while the costs of the proceedings were allocated to the defendant pursuant to § 97 Abs. 1 ZPO.
