Non-admission of revision in private law dispute; justification for omitting statement of reasons under § 544 Abs. 6 Satz 2 ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the non-admission of revision, effectively leaving the lower court's decision in force and ordering the plaintiff to bear the costs of the proceedings. The dispute involved a civil matter where the plaintiff sought to challenge the Kammergericht's refusal to admit a legal appeal (Revision), but the BGH found no grounds to overturn that refusal. Relying on Section 544(6) Sentence 2, Second Half-Sentence of the Code of Civil Procedure (ZPO), the court explicitly dispensed with a written statement of reasons, determining that a justification would not contribute to clarifying the conditions under which a revision is to be admitted.
