Dismissal of complaint against non-admission of civil revision without written justification
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Civil Jurisdiction (BGH) dismissed the defendant's complaint against the non-admission of revision, leaving the judgment of the Oberlandesgericht Naumburg in force; the defendant bears the costs of the complaint proceedings, and the subject matter value is established at €109,634.94. The dispute involved a civil litigation where the defendant attempted to challenge the lower court's decision to refuse the admission of an appeal to the BGH, effectively contesting the procedural prerequisites for entering the final instance. The court declined to provide a written justification for its decision, applying the doctrine that such an explanation would not contribute to the clarification of the conditions under which a revision is to be admitted, pursuant to § 544 Abs. 6 Satz 2 2. Halbsatz ZPO.
