Legislator-Zusammenfassung

KI-generiert

The German Federal Court of Civil Procedure (BGH 7. Zivilsenat) dismissed the plaintiff’s complaint against the non-admission of revision by the Munich Higher Regional Court, thereby upholding the lower court's decision and ordering the plaintiff to bear the costs of the proceedings with a subject matter value of €66,361.68. The dispute concerned a civil matter in which the plaintiff challenged the 28th Civil Senate’s refusal to admit the case for revision due to a lack of requisite legal significance or divergence from precedent. The BGH declined to provide a reasoned opinion, citing § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, which permits omitting reasons when they would not contribute to clarifying the prerequisites for admitting revision, thus confirming that the substantive ruling of the appellate court remains in force.
