The German Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the non-admission of revision, thereby leaving the judgment of the Higher Regional Court of Naumburg in force and upholding the defendant's position. The dispute concerned a civil matter where the plaintiff sought to challenge the lower court's refusal to admit an appeal on points of law, with the case involving a Gegenstandswert (amount in dispute) of €88,222.75. The court relied on Section 544(6) Sentence 2, second half-sentence of the Code of Civil Procedure (ZPO), concluding that a written reasoning for the dismissal would not contribute to clarifying the prerequisites for admitting a revision, and ordered the plaintiff to bear the costs of the complaint proceedings pursuant to Section 97(1) ZPO.
