The Federal Court of Justice (BGH) dismissed the defendant's complaint against the non-admission of revision, leaving the judgment of the 15th Civil Senate of the Higher Regional Court of Karlsruhe of April 5, 2023, in force; the plaintiff prevailed, and the defendant was ordered to bear the costs of the complaint proceedings, including those arising from the auxiliary intervention on the plaintiff's side, with a subject matter value of €17,000,000. The dispute concerned a civil litigation matter where the defendant challenged the lower court's refusal to allow an appeal to the supreme court, but the BGH found no grounds to reopen the review of the first-instance decision. The decisive legal basis was § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, under which the court waived a reasoned decision because a detailed explanation would not contribute to clarifying the prerequisites for admitting a revision, thereby upholding the procedural standard for non-admission in high-value commercial or civil disputes.
