Legislator-Zusammenfassung

The defendant’s complaint for leave to appeal (Nichtzulassungsbeschwerde) was dismissed, thereby upholding the judgment of the Stuttgart Higher Regional Court (12th Civil Senate) and leaving that decision final. The dispute concerned a civil matter where the lower court had refused to admit revision, and the appellant challenged this procedural refusal; the Federal Court of Justice (BGH, 7th Civil Senate) rejected the challenge without providing a substantive reasoned decision, finding it unnecessary to clarify the prerequisites for admitting an appeal. The decisive legal basis was § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, which permits dispensing with a statement of reasons in non-appeal admission decisions if such a statement would not contribute to the clarification of the relevant legal conditions. The defendant was ordered to bear the costs of the complaint proceedings, including those caused by the auxiliary intervention on the plaintiff’s side, except for the auxiliary intervenor’s own costs, pursuant to §§ 97 Abs. 1 and 101 Abs. 1 ZPO.
