The Federal Court of Justice (BGH) rejected the plaintiff's complaint against the non-admission of revision, thereby upholding the final judgment of the 10th Civil Senate of the Oberlandesgericht Dresden dated October 27, 2022, and ordered the plaintiff to bear the costs of the proceedings; the court also granted legal aid to the defendant for the non-admission proceedings and dispensed with a written reasoned judgment under § 544(6) Sentence 2, second half-sentence ZPO as the reasoning would not contribute to clarifying the requirements for admitting revision. The dispute involved a civil matter with an amount in dispute of €608,115.63, where the plaintiff challenged the appellate court's decision not to allow an appeal on points of law to the BGH. The decisive legal basis was the procedural provision § 544 ZPO regarding the non-admission of revision, alongside § 97(1) ZPO for cost allocation, and the court concluded that the statutory conditions for justifying a revision were not met.
