BGH complaint against non-admission of revision dismissed without reasoned decision under § 544 Abs. 6 ZPO
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) dismissed the defendants' complaint against the non-admission of revision to the Federal Court of Justice, upholding the judgment of the Higher Regional Court of Stuttgart, and ordered the auxiliary parties to bear the costs of the proceedings. The dispute arose from a civil lawsuit where the appellate court had declined to allow a further appeal, prompting the defendants, represented by their auxiliary parties, to challenge that procedural decision. The court rejected the complaint without providing a substantive legal reasoning, applying § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, which permits the omission of grounds when they would not contribute to clarifying the prerequisites for admitting revision, and assigned the costs under § 97 Abs. 1 ZPO.
