Waiver of reasons in non-acceptance complaint against refusal to admit civil revision
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) dismissed the plaintiff’s complaint against the refusal to admit revision, thereby upholding the Lower Regional Court of Schleswig-Holstein’s final judgment in which the defendant prevailed. The dispute, valued at €324,610.67, involved a civil matter heard by the 7th Civil Senate, where the plaintiff challenged the appellate court’s decision not to allow the case to proceed to the supreme court level. The BGH rejected the complaint without substantive reasoning, invoking § 544(6) sentence 2, second half-sentence, ZPO, on the ground that an explanation would not contribute to clarifying the conditions for admitting revision, and ordered the plaintiff to bear the costs of the complaint proceedings pursuant to § 97(1) ZPO.
